Terms of Use

These terms govern your use of TradeWave, a mobile app for cataloging trading card collections, scanning cards, and following market prices. By using TradeWave you agree to them.

1. Acceptance

TradeWave is an independently developed app. These Terms of Use are an agreement between you and Dominic LaRocca, an individual doing business as TradeWave (“TradeWave”, “we”, “us”, and “our”). By creating an account, signing in, purchasing a subscription, or otherwise using TradeWave, you agree to these terms and to the Privacy Policy. If you do not agree, do not use the service.

2. Eligibility

You must be at least 13 years old — or older where the law where you live requires it — to use TradeWave. You are responsible for making sure your use of TradeWave is lawful where you are.

3. Your account

TradeWave uses Apple and Google sign-in to create accounts and log in. You are responsible for keeping your device and your sign-in provider account secure. You can delete your TradeWave account at any time from within the app. Deletion removes your account, vaults, collection data, sessions, sync data, and friend records, except for information we are required to keep, operational records kept for the periods described in the Privacy Policy, or scan samples stored without account identifiers as described in the Privacy Policy.

4. Your content & visibility

You are responsible for the information you add to TradeWave, including collection entries, acquisition details, profile text, vault visibility settings, and the items you include in a trade request. Profile details are available to accepted friends. Vault visibility has three levels: Public vaults can be viewed by anyone; Friends vaults can be viewed only by you and your accepted friends; and Private vaults can be viewed only by you.

TradeWave lets accepted friends send structured, nonbinding trade requests using selected collection items. A request can be accepted, declined, or countered, but TradeWave does not provide messaging, a marketplace, escrow, payment, shipping, or automatic item transfer. Accepting a request does not transfer ownership or change either collection. TradeWave does not verify authenticity, condition, ownership, or value. Any physical exchange you arrange outside TradeWave is solely between the participants and at their own risk.

5. Scanning & recognition

TradeWave includes on-device raw-card recognition. Recognition results can be wrong. Review and confirm every scan before saving it. Graded slab scanning may use an optional cert-number lookup through our server. If you opt in to contributing scan samples, cropped card images together with text already read on-device and the card label you confirmed are uploaded without your account identifier and may be used to improve recognition, as described in the Privacy Policy.

6. Prices & market data

TradeWave displays catalog data, card images, market prices, price history, sold listings, and similar information sourced from third parties. This information can be delayed, incomplete, inaccurate, or unavailable, and can differ from what any card actually sells for.

Nothing in TradeWave is financial, investment, tax, insurance, appraisal, or legal advice. Do not rely on TradeWave as your only source when buying, selling, insuring, or valuing collectibles.

7. Subscriptions

TradeWave may offer auto-renewable subscriptions purchased through Apple in-app purchase. Billing, renewal, cancellation, refunds, and payment management are handled by Apple through your App Store account settings. Subscription features may change over time; material changes will be handled as required by applicable platform rules and law.

8. Acceptable use

You agree not to misuse TradeWave. Among other things, you must not:

• attempt to access another user’s account or data;
• scrape, overload, or disrupt the service, or bypass rate limits;
• submit malicious content or interfere with the service’s security;
• reverse engineer protected parts of the service;
• use TradeWave for fraud, harassment, spam, or unlawful conduct.

9. TradeWave’s property & your content

The TradeWave app, software, design, and branding belong to us or our licensors. You keep the rights to the content you submit, and you grant us a license to host, process, and display that content in order to provide, secure, operate, and improve the service.

10. Pokémon & third-party rights

TradeWave is an unofficial, fan-made tool. It is not produced by, endorsed by, sponsored by, or otherwise affiliated with Nintendo, The Pokémon Company, Creatures Inc., GAME FREAK inc., or any card manufacturer, grader, or marketplace. Pokémon and all related names, logos, characters, and card artwork are trademarks and copyrights of their respective owners.

TradeWave does not create, host, or claim any ownership of card artwork. Card catalog data and card images are supplied by third-party trading card data providers (currently Scrydex) and are displayed solely so you can identify and catalog cards you own or are evaluating. These terms give you no license to copy, download, or redistribute card artwork or other third-party material, and you must not use TradeWave to do so.

If you are a rights holder and believe material available through TradeWave infringes your rights, contact us as described below and we will address it promptly.

11. Copyright complaints

We respond to notices of alleged copyright infringement. Send notices to [email protected] with: (a) identification of the copyrighted work; (b) where the material appears in TradeWave; (c) your contact information; (d) a statement that you believe in good faith the use is not authorized by the rights owner, its agent, or the law; and (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights owner or authorized to act for them. We will review promptly and remove or disable access to material where appropriate.

12. Changes & availability

We may change, suspend, or discontinue features at any time. We may limit access or remove content where necessary to protect users, comply with law, enforce these terms, or operate the service. We do not guarantee that TradeWave will be uninterrupted or error-free.

13. Disclaimers

TradeWave is provided “as is” and “as available”, without warranties of any kind, to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability.

14. Limitation of liability

To the fullest extent permitted by law, TradeWave will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost value, purchase decisions, or service interruption, even if we were advised such damages were possible.

15. Termination

You may stop using TradeWave at any time. We may suspend or terminate access if you violate these terms, create risk for other users, or use the service unlawfully.

16. Changes to these terms

We may update these terms. If changes are material, we will give notice in a reasonable way, such as an in-app notice or an updated effective date on this page. Continued use after changes take effect means you accept the updated terms.
